we” are the party that will carry out the works as agreed in the quotation.
you” are the customer who has agreed with us to complete the works that are described in the quotation.
“the works” are the materials and labour to be constructed and supplied by us as described in the quotation.

1.0 Our obligation to you

1.1 We will supply and install/construct the works that are briefly described in the quotation in accordance within these terms and conditions; which cannot be changed unless both parties agree; in which case, this must be in writing.


1.2 Any additional terms, conditions or verbal agreements should also be written down for the sake of clarity and also be signed by both parties.


1.3 We shall endeavour to carry out our obligations to you under this agreement to the highest standards possible, efficiently and resourcefully.

2.0 Your obligation to us

2.1 You will give us reasonable access to the site; to enable us to carry out the works by ourselves at times agreed between both parties, before the commencement of the works.


2.2 If in the unlikely event that the works will take longer to complete than initially estimated due to unforeseen circumstances; we will give you as much notice as possible with a detailed explanation and revised completion date.


2.3 It is your responsibility to ensure that all furniture, radiators and fittings have been removed from the agreed works sites prior to the works start date due to the risk of damage or contamination during the works.


2.4 If you live in an area where parking restrictions apply and you have no off street parking at the works site you will have to arrange parking with the local authority in the form of a suspended residents or parking bay.


2.5 Failure to supply suitable parking will result in any parking/clamping/removal fees being added to your final invoice.


2.6 Pets and children are strictly forbidden from entering the works area for the reasons of health and safety and inadvertent damage being caused by them to drying works.


2.7 Electricity must be isolated if required.

2.8 Waiting time will be charged for complete hours at the rate of £50.

2.9 You must allow us to complete the works as agreed. Failure to do so will render you liable for our costs as we may be unable to arrange further work to fill your slot and monies may have been paid on materials and labour when the contract was initially agreed.

2.10 You must be accurate and honest with your description of works required and the environment where work will be carried out. This is particularly important if we quote unseen. Failure to do so may give rise to an increase in price and being liable for our costs if you decide not to go ahead with the works. An example - 40 square metre ceiling to plaster - on arrival we found that the ceiling was over a swimming pool and there were wooden beams and complicated angles to plaster also! It does happen.

2.11 If you have specific or prefered requirements please detail them as they may not match current standard practice. An example - you may want uPVC external beading when stainless steel is commonly used.

2.12 You must not display agressive or threatening behaviour to our staff. Withdrawal from works is strongly encouraged and in extreme episodes Police involvement.

3.0 Our warranty of the works

3.1 We promise to repair or replace any defects in the case of the proposed works that are a direct result of poor workmanship for a period of 3 years after the date of completion of the works.


3.2 Any defects found within the works must be reported within 21 days of completion. Within reasonable time; an investigation will commence. Once the cause of any defects has been established and agreed upon by both parties, we shall rectify the problem at our own expense. However, this promise does not extend to any defect arising from fair wear and tear, breakages of glass or damage not caused by any defects in the products or their installation.


3.3 We will not be liable for any cracks that appear as long as we tape/EML (expanding metal lathe) all visible cracks before commencement of the agreed works, this occurrence is unavoidable if there is any structural movement present. If heating is used within 72 hours of installation we will not be liable for quick drying cracks. While on site we will rectify such hairline cracks but normally these should be dealth with at the time of decorating.

4.0 The contract, price and payment terms

4.1 The price becomes payable immediately after the works have been completed, then a receipt will be given from us on funds clearing.


4.2 The final price shown on this estimate is subject to change in the case of unforeseen circumstances (Examples - defective structure, additional works added or previously unspecified more expensive materials or detail added).


4.3 All work is to be carried out strictly in accordance with the building regulations where necessary. Contravention of the building regulations by building without making application to the local authority (or approved building inspector), or by carrying out work that does not comply; may lead to a criminal conviction and a fine not exceeding £5000 plus £50 per day continuing fine following conviction. Both the owner and the builder have a responsibility to make sure a building regulation application is made before work starts and that notification of the various stages of work is given to BCCS (building control consultancy services).
Building regulations are a legal requirement to ensure the health and safety of people in and around buildings.


4.4 All materials remain the property of plastermaster.org until full and final payment has cleared.

4.5 If a job is scheduled to last more than 2 days, up to 50% of the quote will be payable before the start date to assist with paying for materials, any hiring of equipment and any labour.

4.6 Equipment Hire - where equipment is on hire and the works are delayed due to inclement weather any aditional cost will be added to the final invoice.

4.7 Pursuant of item 4.1 an administrative fee of £30 will be added if payment is not received within 5 full working days from the date of completion. A reminder will then be issued each week and this will attract a fee of £5. (This item has had to be added due to a minority of late payers which adversely affects cash flow and prompt payment of suppliers and sub contractors).

4.8 In addition to 4.4 customers must specifically request to keep spare materials (if there are any) otherwise they will be disposed of or kept for the next works if appropriate by plastermaster.org.

 

Electricity – Power isolation must be viable in case we need electricity off. Please familiarise your self with your consumer unit location and access to it.
Esitmate – A rough guide to the cost of works which is subject to change. Vaild for 3 months from the date of issue.
Fittings – Radiators, curtains, curtain tracks, downlighters,
Parking – Please ensure you arrange parking if required as penalty fees can escalate and we are unable to bear this cost.
Quotation – A final price for the works which is fixed and will only change under exceptional circumstances.
Radiators – Radiators have to be removed in order to plaster behind them. Our public liability insurance will not cover us to remove them should any damage ensue. Even qualified plumbers make mistakes with radiator removal. A disturbed system can also stir up slurry which can adversely affect your central heating performance. If you have difficulty contacting a plumber and are unable to remove them yourself we will undertake this work under the above caution at extra cost.
Waiting Time – If the works site is unavailable at the agreed time waiting time may be charged for whole hours at the specified rate. This is to compensate us for finishing later in the day or adding an extra day.

Skirting Boards - If skirting boards are removed before plastering - we will plaster down to approx. 6cm from the floor level - ready for new skirting to be fixed. This prevents floor movement cracking the plaster and protects the plaster from any liquid spillage on the floor. If you are not having skirting board a stop bead will have to be placed horizontal to the floor at a height of 10-15mm from the floor. This will provide a neat edge for edging material such as laminate flooring quadrant.

Excess Materials - If materials are left over from works and you wish to keep them please specify this as soon as possible as they will either be removed as waste or removed for re-use if appropriate.

RECTIFICATION - You must allow us to rectify any defects or areas which do not meet your specifications.

Miracles! - DO NOT expect a silk purse from a sow's ear! Be reasonable and have fair expectations particularly with remedial plastering on existing substrates which will often need a light sanding prior to decoration in places.
